> Eddie Bazil
Hi,
I am Eddie Bazil of Samplecraze the duly authorized representative of the exclusive rights holder Hip Hop Producer Set Mega.
These exclusive rights are being violated by material available upon your site at the following URL(s):
http://audioz.eu/samples/audio-loops/page/5/

Here is the link to the product on my website:
http://www.samplecraze.com/product.php/262/hip-hop-producer-sets-1-and-2/

I have a good faith belief that the use of this material in such a fashion is not authorized by the copyright holder, the copyright holder's agent, or the law;

Under penalty of perjury in a United States court of law, I state that the information contained in this notification is accurate, and that I am authorized to act on the behalf of the exclusive rights holder for the material in question;

I may be contacted by the following methods (include all)

In the interim, we are fed up of contacting you continuously for removal of our infringed content and as our publishing lies with the BMI in the USA and MCPS in the UK we are leaving them to sort out the legal implictaions of this continual abuse of our shared content.

> AudioZ
Hello Eddie,
surely, the post you referring to has been removed from AudioZ.

All the best.

> Eddie Bazil
Hi,

Google probably removed it as I submitted a number of infringements to them.

This one still sits on your site even though in the past I have requested it to be removed many times.
http://audioz.info/index.php?do=search

TBH, I am getting really fed up of chasing companies like yours for infringements and therefore have passed these details onto our USA publishers.

Thanks,
Eddie

> AudioZ
- well, if that's how you want to play it, then there's no point for me to be cooperative with you.
i'm just trying to be the good guy here and respect developers wishes;

i don't care about any other web-sites, this is how things work on AudioZ.

So, think about it before sending any threats in our way.

Good luck.

> Eddie Bazil
It's not a threat, it's called 'anger and disgust'.
You think you are doing me a favour by removing stolen content and offering it to your userbase to generate traffic you can benefit from?

Personally, I find people like you both detructive and fraudulent.

You say you don't care how other websites operate huh? Well, how many times do I have to write to your company to have content removed and once it is you give it a few days and up it goes again and I have to go through the same procedure every time? Same old practices by the same old thieving sites.

You think our publishers won't take action for one source? Really, so loss of income through you flagrant abuse makes it a non starter for all concerned?

Fine, you have a simple choice and it's not about you getting angry, because personally, I hold people like you in contempt, so if you think you are co-operating and then threatening not to co-operate because people like me get sick of being thieved by criminals like you then you need to think again. The freeloading days are coming to a close for thieves like you, so either remove our infringed content immediatley or we will take this a step further and hold you liable.

You don't want to co-operate, fine with me. We will pass all email dialogue to our publishers and their lawyers and then watch the fun.
BTW, these copyrights are also owned by MCPS, so I am sure they might like to grovel to your kind needs.

You decide. I am happy to commence litigation and with the current laws in place you cannot hide anymore behind the 'we don't host any...rubbish' anymore.
You provide direct links to infringed content and you benefit from it, so if you think you are above the law say so and we'll amp this up a notch.

Like I said, you decide. If you feel brave then go for it. If you're sensible, you'll apologise and maybe, just maybe, stop thinking you're not just a plain thief benefitting from other peoples' hard work and creativity, or do you actually provide anything of subtance and benefit to your userbase?

This email has been cc'd to all involved.

If our content is not removed within the next two hours we will instruct lawyers to commence litigation against you and, under Google DMCA directives, your site will be suspended until, this is resolved.

Best of luck.

> Eddie Bazil ...(after 3 days)
I was going to let this go since you removed our content from yuor site but you clearly haven't got the message and now I will instruct lawyers.
You have missed one of the most important cardinal rules about uploading content on the internet: it is forbidden to violate people's privacy laws and you have done just that. I don't need to litigate against you from the USA now, I can start from here in the UK as the laws here are very strict about violation of privacy.

You, by law, do not have the right to print any conet from private emails. Do you know anything about the law or do you just systematically abuse it at will, like Pirate Bay did? Do you not realise that Pirate Bay were taken to cousrt and found guilty not just for abuse of copyright but for uplaoding private email conetnt from copyright owers? This was done to embarras them.

I am not embarrassed but seriously annoyed. I was going to leave your company alone but now I will instruct lawyers.

As long as that disgusting display of arrogance by you on your website to upload and share our dialogue stays the stronger the case.

You will be litigated against and be sure of that.

Now go brag that to your equally thieving subscriber base who, through the laws of data protection, will now be contacted by our lawyers to offer indemnities.

Don't write back to me as the emails between us are already with BMI and MCPS lawyers. Now I have added my lawyers to the list.

Once you have been prosecuted and your site suspended and your subscriber base contacted then we will see who publishes what about whom.

alternately you could enable a
registration scheme

Hi pyrusmalus ... There's something i can't understand and i think that maybe you (or anyother here) could kindly clarify it to me. How is it that almost all experienced users (maybe also site administrators) think that going private will prevent this kind of things ? ... Is it not that still there will be "piracy" for the so called "corporate America" to act against ?

I just want to understand, so much thanks in advance! mates

Not necessarily 'going private', but rather -- 'closing the shade on an open window'

I was merely suggesting a 'less blatant' (obvious & conspicuous) method of information & file distribution

IMHO, I'd probably never have heard of samplecraze (and lots of other vendors) without sites likes this. I certainly would not have heard any of their sample sets, which would make it even less likely that i'd use any of their samples (loops/presets) in a production. However if I did ever audition one of their samples and decided to use it in a track then I would 100% be buying those samples (as i do with others).

Their samples are reasonably priced (and discounted atm), but I still can't afford a hundred bucks (or more) for their collection to know if they are really of any value.
There are SO many poor sample CDs and im not even going to start on how many times in the past i've bought sample cds/romplers etc only to realise that it's not as good as it's name, hype or sleave artwork!

You usually would not buy a record without listening to it would you?
Unless of course it's from one of your favourite artists or a label that you can almost always count on being really cool.

Some may find these samples craze construction kits etc useful, though they are not for me.
Maybe in the future they will release something of use, maybe I won't get to find out.

I'm guessing you can expect a lot more threats of legal action in light of the recent Megaupload take down, it's all part of the witch hunt.

It is a double edged sword, the same as MP3... I know for a fact that people play my tunes in clubs and bars only because they downloaded the track without paying for it. And these days compilation sales are lower with people making their own from things they download.
I just call it promotion, even though it does detract from some sales I don't have to mail out hundreds of records like i used to and it all adds to the profile!! I also know from experiance that these days no matter how much something is hyped or pushed you can only gaurantee sales from really QUALITY product because the market is saturated.

I like to believe that most people who are Pro-Audio are somewhat legit...
At least they should be and/or aim to be!!

I see a number of people on this thread mentioning making this a "register-to-see-content" site, and I must say while I don't think its an answer for all the potential difficulties a site like this can have, it does help with many of them. Given the current environment, and the U.S. deciding to play 'world cop' (for a change) over file sharing, changing over to that format might really help the place survive.

Five years ago I would have said to heck with them, what are they going to do to you? But today its a different story. It's as if there is no U.S. Constitution any more, the only rules that seem to apply are the interests of corporations. And none of us want to see anyone wind up in jail, or have their lives made into a complete mess just because we wanted to check out some music software.

By the way, I am from the U.S., so please don't take what I'm saying as just some anti-American rant. Though I'd be the first person to tell you that the U.S.A. has completely gone down the tubes at this point.

A shortsighted attitude.
if I were a publisher instead to pay lawyers with a confrontative attitude I would invest my money in a team able to negotiate with my worst enemies an expand my position through with deals.
Ok in town has appeared a new and popular way to distribute, turn your enemy in your partner.

Also, you must note that this site DOES NOT have any copyrighted software or samples, but only LINKS to OTHER websites. A link is an INFORMATION. If informing people is illegal, then, telling someone (like on a phone directory) where or how to find something should also be illegal...

Well, where I come from this is illegal. So it doesn't really matter if you are hosting a file or just give the information (depending on ruling laws).

It has been like this for centuries. If someone here has time to read and understands spanish language (i don't know if there's an english translation) i would suggest you to read "Las Venas Abiertas de America" (The America's Open Veins). There you'll find this philosophy since Columbus descovered America to our present days by the so called civilized Europeans and North Americans.

Are you sure that is just "today" that "the story is different" ? ... I think that "yesterday" it was the same, and the "day before yesterday", and so on so forth. Or do you think that many of the laws aproved around the world are really democratic ? ... Maybe it seems so apparently, but in the root ... do you know really who proposed the rule ? ... Of course!, it may pass or not, but if it not passes they will try and try and try once and again and if eventually they can't they will do (have done most of the times) by force. Human history is plenty of really good examples of what i'm saying here, you can open your eyes and see. Democracy ? ... What Democracy ?. damn

Happy to see that you North Americans are begining to open your eyes, but if you don't run i'm affraid that they will put again a bandage in your eyes and a sticking plaster in your mouths. And if they acomplish to do that on you, you can imagine what they will do to the rest of the world. And when i say "they" i'm not refering precisely to your government. You yourself can guess of what i'm talking about. damn

Don't get wrong, Internet has made that people all around the world start to open their eyes, and THIS IS THE ONLY REASON they want to put it down. Piracy is merely an smoke screen and IMHO most of you are wasting your time talking about samples and so on so forth. But of course, this is only my opinion and with this i'm sure i've made more friends than if i had facebook or twiter or anything else ... those who are now spoting at me in the shadows because me talking about this things openly. damn

SAINT, I think you're doing a great job with the site. I like the idea of "only registered members" but that would only provide very limited security, personally, I would go one step further and make any new members by referral only...that wouldn't solve it totally but it would help. As far as the piratebay and megaupload cases go, it's clear that they are coming, being a bit more inconspicuous is key in these times.
I've got it made and I'm still too busy to argue with you!

No Panic:
1. No law against Sites That are not "self Material hosted".
2. Google will take no action to the request of Eddi Brazil. There are 1000's sites who share daily 300 Posts.

I think Audioz however have to respect Producers requests who want their content to be removed.

In one point the guy is right; you shouldn't post private E-mails and make them public.
You could summarize his points, and post that, but not the E-mail itself.

Not just because it may be illegal, it's simply bad manners.
I understand if people feel provoked and embarassed by this.

@fraggle83 -

when I used the word "today" I meant it metaphorically. Were I to personally attempt to pinpoint the current malaise in the U.S. I would go back to Bush/Cheney and their (mis)use and distortion of what happened on 9-11 to create a dictatorial plutocracy that effectively destroyed the meaning of the U.S. Constitution. Don't get me wrong, 9-11 was a horror show, and I live not far from where it all happened so I know, but Bush/Cheney used it as an excuse to inch us closer to a dictatorship.

As for your remark about 'beginning to open our eyes', I assure you my eyes have been open for a long, long time. So are the eyes of many people that I know. However 'eyes open' doesn't necessary equal free speech, and the U.S. has become a 'surveillance state' where the police and government have given themselves freedom to do any damn thing they want. Under those circumstances there may be more discontent here then is recognized by people outside of the U.S.

@Saint -

I wouldn't be too concerned about this man's comments about posting his email. Even if posting his message could be construed as some sort of personal invasion in some jurisdictions of the world, he still has to prove what his damages are. Since he openly admits, 'he's not embarrassed, just annoyed', he shoots himself in the foot for any real claim of damages. Flies buzzing around my head annoy me as well, but I can't sue them over it. Further, he complicates matters by then proceeding to slander users of your site, using derogatory characterizations to describe the people that visit Audioz. I could go on, but its clear this fellow is just a clown who wants to get angry and threaten people.

I do still stick to my earlier remarks though that the best policy is to quickly remove posts that you receive complaints about, and to say as little as possible in response to these people. Trust me, the less you say, the better off you will be.

Testify Brother......TESTIFY!!!

The ONLY reason this whole topic is even on "THEIR" radar, We NOW have FREE choice at what WE POST and what WE SEE!

Without "THEIR" control as to what We choose to EDUCATE or TEACH, We are every single day getting closer and closer to pulling down EVERY single LIE, FALSEHOOD and SMOKE SCREEN that "THEY" have spent CENTURIES building! The Common Man has access to SO MUCH KNOWLEDGE. That was NEVER meant to be. While We just looked at "Cat Farting" or "Old Lady Hitting Robber With Her Walking Stick", all was well. BUT, now We have started seeing this, the BIGGEST REPOSITORY OF KNOWLEDGE EVER, for it`s true value, "THEY" are running scared. That, and THAT ALONE is the only reason for the current witch hunt.

Hi SAiNT,

Is he saying that nobody can share any conversation he or she had with anyother with anybody else ?! ... WHAT'S HAPPENING TO THIS WORLD ?! For God's sake! ... Are we become mad or what ?! All this reminds me when i was at school when some kid said to the teacher "look what he said or made!" and then the teacher came to punish you.

I see now, this is a call for fighting for freedom once more because this has nothing to do already with piracy. So, i was wandering if you could not sue him for threaten you in this way. Anyway I suggest you to seek advice from a lawyer in case all what he says were true (if you need some help i know some lawyers here in my country to whom i could ask anything).

What i would tell you anyway, is to think seriously that first are you, then AudioZ and then all the people here ... Don't worry for us SAiNT, we all have enought material to spend not only this life, but hundreds of lifes to experiment with. After all, i always make a joke when i meet friends or known people and they start complaining about internet being closed ... i tell them "you should be happy, now you'll have plenty of time to watch all those movies you downloaded, or to hear all those thousands of CDs you've downloaded, or to read all those thousands of books ... OR to make music with all those thousands of plugins, daws, tutorials, samples, and so on you've got from AudioZ" ... and then they change their worried faces by a big smile!.

SO!, be happy my friend, but OVERALL BE SAFE AND DON'T THINK ON US ... THINK ON YOU AND LISTEN WHAT THOSE WHO ARE CLOSE TO YOU HAVE TO SAY ON THAT!

Good Night my friend, and in case this site were closed tomorrow IT HAS BEEN A PLEASURE TO MEET YOU! SERIOUSLY! mates

I am now banned from Filesonic also.
I have some very strange behavior also with Google or accessing other web site since Megaupload went down.
I believe that my ISP is also doing something.
Time ahead are going to be difficult for some of us and I am in the UK.
I have always been a Audioz fan / activist but now I will have to keep a low profile as it could affect my IT Job unfortunately. It is not the right time form me to mess up with the authority.
All of us will have to be very clever and as someone mentioned already private FTP and torrents may just be back but Torrents have been scanned by authorities for a while now, making this support also Risky. it looks like that we will have to exchange apps by " hands "
like the old time where you meet people to swap 3.5" floppy disks, now we can do that with CD/DVD's. This is for sure a good opportunity to meet each other and to make it going again.
We will be looking like drug dealers though which is soooooooooo bad.
What else now ??????????????????
Good luck everyone.

Thank you Saint also, you Rock,

But I think that you now have also to keep a low profile " so to speak " as there is no other web site for Audio as good as AudioZ.

I will be still here by the way..
