A lot of the time the company is fine with basically all use of the samples--mixtapes, indie prod., small labels, independent artists, etc.--as long as it is not being used on a track that will be distributed on a major label. Then, they usually ask for a 50% cut and half the points. It's not a great deal, but it's not as bad as begging for a measly 6 points like you would have from some major labels. Besides that, if you are publishing through a major label, the label would be the one who would be covering the clearance charges, which wouldn't affect your royalties. (Also, if any major label tells you that you have to clear the samples yourself, tell them to cram it up their ass; that is *not how it works.)

This is so wrong man, everything the label pays out in advance HAS to be paid pack out of your royalties. Every cab trip, every minute of studio time, EVERYTHING!!!

You think a label will pay the license fee of a sample which could run in to the 100's of thousands and not recoup anything from the artist??

what i want to know is why would audioz post things that are not royalty free this pack is basically useless unless you make beats for a hobby more power to you but for people trying to find inspiration and create something great and actually put it to use this is no good you cant do anything with this but listen to it like an album lol am i wrong here??

Everyone is wrong to a degree.. including the makers of this pack. Listen to some of the content. Listen from 1:30 t0 1:42. It would be a cold day in hell before anyone would get taxed for using that in a full composition. They didn't invent any of the basic 8 bar structural changes in this pack. Also, the moment you touch it with an EQ, distortion, or delay, etc.. it equates to a different instrument playing a melodic structure too basic and short for a patented claim to be made.

So there is difference between composition and master material.
You can use the melodies and pitch, slice or recreate it but the sound material is owned by the original creator. He gives you the rights to use this original sample in your music production (not exclusive)

some do what make beats for a hobby ?? what about those that don't u want them to chance getting legal action taken. granted its a choice i would not use anything that is not royalty free. regardless if i could flip a sample better than kanye it just dont feel right using something that someone made there clearly asking you do not use this to try and capitalize on the art you create without reaching out to us first. its jus too many loops to jump through when u can just get a royalty free sound and work freely i.e. i have worked with a major label and they can find out if something is free to use or have restrictions regardless of how good you flip it the major artist is not going to want to touch it with a 10 foot pole just food for thought when posting these things...even the guy or girl w/ith a hobby may want to try his or her hand at the majors thats why im posting and when they ask what did u use to make these specifically because they do and will the flipped sound wont matter there going to scratch it.
