Yes, explain this to the judge when you appear in court... When you produce commercial audio/video you don't want to mess with copyright, except when the samples used are explicitly royalty free in the license agreement

Show me any case in any court in any country where someone was sued for misuse of a samplepack or videogame audio for that matter? If you're not sampling the big boys and you're not making big bucks off you're audio then no one cares and it's not worth it. The only reason anyone goes to court is financial incentive, and the amount you could be ordered to pay will be in respect to what the tracks is earning, and they'd only bother taking you to court in the 1st place if there was decent money being made of it, in which case you'll be able to pay. Sample away my friends, there's virtually no risk.

When you use a sample without clearance and your song starts generating money , be ready to face a gang of lawyers ready to devour you (been there, done that). It happens that when you produce audio/video for commercial use, you can't know in advance whether what you've done will become gold or not, if it does you're screwed. For this reason, it's good practice to avoid sample packs that aren't 100 % royalty free (read fine prints too). Or better yet: avoid sample packs completely.
If you use the sample just to jam in your bedroom studio, then there's no problem
