Some material may have copyrights that are technically still intact, but the farther back you go, you may find that the *actual copyright owners--film companies, record labels, etc.--have long since dissolved, thus, leaving no one with the legal right to go after you.
I think it may have been Wu-Tang who ran into that; a company tried to sue them for illegal use of snippets but, once in court, it turned out that the company didn't actually own the copyright, they just it assumed it passed to them when the original company, long defunct, sold it to them. That wasn't the case and the judge dropped the case.
Honestly, I don't know, or have even heard of, anyone who's ever gotten any blow-back from using *old radio/television snippets but, as I'm sure someone will pounce on me, *yes, it *is possible that it can happen, I've just never seen or heard of it.
(And the point of using samples if they have copyrights, for people like me anyway, is to see if we can flip something so that it becomes unrecognizable, blending into it's surroundings and making it our own. )
