Yes! I'm just realizing that now while trying them and came here to make a comment! He cannot use samples to redistribute like that in "sample packs", even if he paid for them... Some of them are from NI Machine expansions...

He's clearly lying in his statments, you can see that in his puckered forehead and his eyes, the most basic evidence of it...

Still good for those who don't use Machine but be aware that when you buy samples if those samples are infringing some law YOU are the guilty too, not the sample (infringed ones) distributor. You will have a process and he will have another distinct one!

That's one of the reasons that you have to be carefull buying samples. Only buy from clear and known distributors!

shastra, basically you can't be considered guilty if you have no animus nocendi, i.e. if you didn't know you were doing something unlawful... That's a pretty universal idea in law (in any Western country at least). Anyway, you can not be sued for using a simple sound, even if you don't clear the rights for using it. A drum sample is only one note, which is not long enough to be protected by intellectual property. (But stealing a whole sequence is illegal, of course.) I know my legal stuff, believe me. You can use these samples with confidence.

One drum sound may not be one note if it's not tunned! Some drums are just percussion... This it's not about phrases/notes, this is about SAMPLES property!

One sample it's different from one note. Basically sample it's fisical and note its intelectual concept.
You can use up to three consecutive notes of another artist's work without being sued or being considered plagiarism but you cannot use samples without proper authorization.

I know what I saying, I searched for this information some time ago and I kind of agree with that.
It's about work, idea, concept, development, distribution, partnership: that's the property!
If you don't buy from proper resellers/distributor you're "in the black market"... You can say you didn't know that it was stolen BUT you did know you were in the black market!

Imagine this: You take one kick from "Battery", another kick from "Rob Papen Punch", another kick from "Nerve", another kick from "Sparks", another kick from "Steven Slate Drums" (only for the steven slate you're already condened!), another kick from "Abbey Road 60's, 70's, 80's", etc... And you make a sample pack of kicks and sell it. You make a lot of money with others work???

Believe me when I say this if they catch (they may not catch you) you will be sued if they want! There's simply a toon of cases like this... and the famous Vengeance that made what you're saying in his first kick packs... He extracted vinyl kicks (saying to himself it's just a note) and got sued!

This is EVEN in the U.S. law, I don't have the link to the website/article/statment about this but if I find will post it.
